0. Acceptance of the general conditions

The website www.groix-et-nature.com (referred to as "the website" hereinafter) is an e-commerce website. It is published by the Groix & Nature simplified joint stock company (SAS) (the "seller") whose headquarters is located at Mez Ker Port lay 56590 GROIX, registered with the company register under the number 35070621400037 (check the company's legal existence), the seller.

The website allows the seller to offer foodstuffs and food-based derivatives for sale to users browsing the website. These general conditions of sale must be consulted and explicitly accepted for all orders of products on the website without this acceptance being dependant on the handwritten signature of users. Double-clicking represents the undertaking of consumers. These conditions apply to the exclusion of all other documents.

The seller reserves the right to change these conditions of sale at any time. However, these changes shall not apply to bookings and orders previously accepted and confirmed by the buyer.

Users may save or print these general conditions of sale, provided that they are not changed.

Users state that they have no intention of reselling the products purchased. Resellers interested in the products distributed by Groix & Nature are asked to contact us.

1. Products sold

All offers of products proposed on the website are limited to countries in which the website allows it: European Union and Switzerland.

Buyers may, prior to placing their order, check on the website the essential features of the product they want to order together with examples of uses. The pages presenting products indicate whether they are unavailable. Having placed an order, however, you will be given notice of any stock outage of one or more products by e-mail. You can also cancel an order placed on the website by contacting the customer service on + 33 (0)2 97 85 85 18. You should be aware, however, that any expenses incurred in ordering raw materials used for the order may be charged to the customer.

Photographs featuring products are only suggestions of product presentation. They may not be used without the prior consent of our company which owns the rights.

Any promotional offer is only valid within the validity time limit of the relevant offer.

2. Prices

The prices quoted are ex-works prices in euros including all taxes and VAT, and are subject to change during the year.

They do not include shipping costs, which are charged on top of the purchased products, depending on the weight and the geographical area to which the order is to be sent. Shipping charges will be shown after the buyer has registered the order, at the payment stage.

The products ordered are billed at the price charged at the time the order is registered.

3. Orders

All orders imply the full and unreserved acceptance of these general conditions of sale. Before orders are confirmed, buyers are required to state their acceptance of these general conditions of sale by ticking the corresponding "I accept" box.

Once orders are registered, a detailed acknowledgement of receipt is sent to buyers, at the e-mail address they indicated. This acknowledgement of receipt will specify the exact amount charged and the order terms of delivery, and implies acceptance of the order and approval of the transaction.

The seller does not accept any liability for any error made in the wording of an order by the buyer.

4. Payments

All orders are payable in euros on the date the order is placed.

The buyer is required to pay by one of the credit cards accepted on the website: Visa, Master Card or Carte Bleue.

The Credit Agricole Group provides you with secure payment on a secure server: your bank account details do not pass through our server. The order will be considered effective upon payment confirmation by banking centres.

The seller reserves the right to suspend or cancel any order in the event of non-payment of any sum owed by the buyer or for any legitimate reason such as a previous dispute relating to a payment or delivery.

5. Delivery

The products are delivered by Colissimo and their Swiss or Europeans partners to the address indicated by the buyer on the order form. The buyer agrees to examine the whole package and refuse it if it is damaged and state the reason for the refusal in the documents certifying its delivery. Any subsequent complaint about the consignment's conformity (types of products, quantities delivered) or quality must be mentioned on the return form, within a period of 7 (seven) days from the date the customer signed for the consignment.

In the case of a damaged package, the order will be returned free of charge to the customer upon receipt of the damaged package.

In the event of a dispute relating to the delivery's conformity after its acceptance, the recipient must take all the steps required to allow the seller, its agents or assignees to establish contradictory findings, including keeping the goods intact and sending them back to us at your own expense for inspection.

If we acknowledge a conformity defect or flaw in the goods sold by us, our liability shall be limited to refunding or replacing the goods, and refunding your shipping charges for returning of the goods, to the exclusion of damages or penalties.

Delivery shall be made within a maximum period of 15 (fifteen) days in mainland France, thirty (30) days for the French overseas departments and territories, and the other countries of Europe and Switzerland, from the approval of the order by the Bank and according to the delivery method chosen.

Depending on the availability of products, and for logistic reasons, several packages may be delivered to customers for a given order at a given address. Customers will then only pay for one delivery. If customers want the second parcel to another place of delivery, they will then have to pay for this transport themselves.

Customs duties, including any import taxes or excise taxes that may be payable, shall in all cases be borne by the recipient and shall not give rise to any claim or request for compensation made to the seller. If a consignment is retained by a customs department, the seller declines any liability for the delay caused.

6. Force majeure

All force majeure or fortuitous events, i.e. events beyond the control of the parties, and which were not reasonably foreseeable or surmountable, making it impossible to honour some or all of the obligations resulting from the performance of orders or contracts throughout such events.

The following events are in particular considered to be force majeure or fortuitous events, releasing our company from its obligation to deliver within the initially scheduled time-frame: strikes, lock-outs, supply difficulties affecting our company or its usual partners, fire, floods, production stoppages due to accidental failures, epidemics, thaw barriers, roadblocks and transport difficulties.

If such events last longer than 30 (thirty) days from the date of their onset, the contract of sale may be terminated by either party, without either the party being entitled to claim for damages.

7. Return and refunding of products

Nonconforming or defective products (except as regards the right of withdrawal) may be returned by the buyer in strict compliance with the conditions and instructions below:

- Products must be returned in perfect resale condition and their original state (packaging intact and unopened, accessories, instructions, etc.), together with the signed "Return form" (included in your parcel).

- This Seller shall accept its return within 14 (fourteen) days of the date the order was delivered to the Buyer.

- The carriage costs of the return parcel shall be borne by the Buyer. If there was an error in the delivered reference or the delivered products were non-compliant, the return costs of this (these) product(s) shall be refunded by the Seller.

All risks relating to product return are the Buyer's responsibility.

If Buyers do not comply with this procedure and time-frame, they shall not be entitled to make any claim for nonconformities or apparent defects in delivered products, which shall then be deemed be compliant and free from any apparent defects.

8. Withdrawal

Under the terms of Article L121-18 of the consumer code, consumers have the right to inform sellers that they want to cancel the purchase, without a penalty and without giving any reason, within 14 (fourteen) days of delivery. If buyers exercise this option, they must return the goods to the seller in their original condition at their own risks and costs for refunding purposes. Returned products shall be refunded provided that the return procedures and instructions and described in point 7 above are met. Refunding shall be through credit cards being re-credited within 15 (fifteen) days of receipt of the parcel.

9. Guarantee

Our preserved products should preferably be stored in cool, dry premises. The shelf life of products are guaranteed by Groix & Nature and must be complied with by customers. Groix & Nature's liability shall be limited to the value of the product in question on the date it was sold.
